Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the SpeakSmart AI mobile application and website (together, the "Service"), operated by SpeakSmart AI ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility & Accounts

• You must be at least 16 years old (or the age of digital consent in your country, if higher) to use the Service.
• You're responsible for keeping your login credentials confidential and for all activity under your account.
• You must provide accurate information when registering and keep it up to date.
• One account per person. You may sign in with email/password or with Google.

3. Subscriptions & Billing

SpeakSmart AI is offered under a free trial followed by paid subscription plans. Plan names, limits, and pricing below are illustrative of our standard offering — the price and terms shown at checkout in Google Play or on our web checkout are always authoritative and may differ by region or promotion.

• There is no permanent free tier — once your trial ends, you must subscribe to continue using the Service.
• Subscriptions are billed weekly or monthly depending on the plan you choose at signup, and automatically renew until cancelled.
• If you subscribe through the Google Play Store, your purchase, renewal, and cancellation are handled by Google Play under Google Play's Terms of Service.
• If you subscribe through our website, your purchase is processed by LemonSqueezy, our merchant of record for web sales.
• We may change plan pricing or limits going forward; if a change affects an active subscription, we'll provide notice as required by the platform you subscribed through.

4. Cancellations & Refunds

• Cancelling stops future renewals but does not refund the current billing period — you keep access until the end of the period you already paid for.
• Manage or cancel a Google Play subscription through the Play Store app or play.google.com/store/account; manage a web subscription through the billing portal link in Settings.
• Refunds are handled by the platform you paid through — Google Play's refund policy for Play Store purchases, or LemonSqueezy's policy for web purchases. We don't independently process refunds outside of those platforms, but you can always contact us at support@speaksmartai.app if something went wrong and we'll help however we can.

5. Acceptable Use

All text you submit — spoken answers, typed answers, CVs, job descriptions — is automatically screened for disallowed content before being processed. You agree not to submit content that is:

• Sexual content involving minors, or other unlawful sexual content;
• Hateful, discriminatory, or threatening toward a person or group;
• Violent, graphic, or intended to incite violence;
• Related to self-harm (if you're struggling, please reach out to a mental health professional or local crisis line — we want you safe, not scored);
• Harassing, abusive, or intended to threaten another person.

You also agree not to: reverse-engineer the app; attempt to bypass usage limits, rate limits, or paywalls; scrape or automate interactions with the Service; impersonate another person; or use the Service for any unlawful purpose. We may flag, block, or remove content that violates this section, and may suspend accounts for repeated violations (see Section 8).

6. AI Content & No Professional Advice

SpeakSmart AI uses generative AI (including third-party large language models) to generate interview questions, follow-ups, scores, and feedback. AI output can be inaccurate, incomplete, or inappropriate for your specific situation. SpeakSmart AI is a practice tool, not career, legal, financial, immigration, or psychological advice — don't rely on it as a substitute for professional guidance (for example, for actual visa/immigration interviews, consult a qualified immigration professional). You're responsible for how you use any feedback the Service provides.

7. Intellectual Property

• We own the Service, including its design, code, and the AI prompts/feedback frameworks behind it. We grant you a personal, non-exclusive, non-transferable license to use the app for your own practice.
• You retain ownership of the content you submit (your answers, CV, etc.). You grant us a limited license to process that content solely to provide and improve the Service, as described in our Privacy Policy.
• "SpeakSmart AI" and our logo are our trademarks. Don't use them without permission.

8. Suspension & Termination

You may stop using the Service and delete your account at any time (see Delete My Data). We may suspend or terminate your access if you violate these Terms, misuse the Service, fail to pay applicable fees, or if required by law — where practical, we'll provide notice first. Upon termination, your right to use the Service ends immediately; data deletion is handled as described in our Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED FEEDBACK WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSE. WE DO NOT GUARANTEE ANY PARTICULAR OUTCOME (E.G., PASSING AN INTERVIEW) FROM USING THE SERVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPEAKSMART AI AND ITS TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which SpeakSmart AI is established, without regard to conflict-of-law principles, except where local consumer-protection law requires otherwise. Any dispute will be resolved in the courts of that jurisdiction, unless applicable law gives you the right to bring a claim in your local courts.

12. Changes to These Terms

We may update these Terms from time to time. We'll update the "Last updated" date above, and for material changes, provide additional notice (such as an in-app message) before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
